Real Estate Disputes

Commercial real estate disputes often carry high stakes and time-sensitive pressures. For owners, developers, buyers, sellers, landlords, and tenants, delays can be costly and disruptive.

Matasar Jacobs represents sophisticated clients in disputes involving purchases, sales, leasing, financing, management, construction, and title restrictions. Our attorneys have particular experience in pursuing extraordinary remedies such as specific performance, injunctions, and judicial transfers of title to protect our clients’ real estate interests.

As skilled litigators and negotiators, we adapt our strategy to achieve favorable outcomes while minimizing business disruption. With a deep understanding of real estate law and a practical approach to dispute resolution, we guide clients toward solutions that preserve both their assets and objectives.

We regularly represent clients in disputes involving:

  • Acquisition and sale of commercial properties;
  • Leases for retail, warehouse, industrial, and office space;
  • Financing of real estate assets;
  • Construction contracts and disputes;
  • Title and boundary contests; and
  • Mechanics’ liens.

Success Stories

Won Property Sale for Joint Venture Despite Competing Buyer

Our attorneys represented a joint venture in a lawsuit triggered when a seller of an undeveloped parcel of property refused to proceed with the sale as a result of a competing buyer trying to exercise a right of first refusal. Using injunctive relief and accelerated trial procedures, the joint venture purchased the property after the court rendered judgment in its favor.

Enforced Landlord Rights in COVID-Era Tenant Disputes

We represented the owner of multiple large retail centers in multiple disputes and lawsuits with tenants regarding failure to pay rent and novel issues related to the COVID-19 epidemic. We obtained judgments and negotiated resolutions to enforce the landlord’s rights and secure recovery.

Forced Seller to Complete Commercial Property Sale

Our attorneys have pursued claims on behalf of a commercial real estate developer when a seller failed to close the sale of a commercial property on the closing date. The seller agreed to sell the property during the trial before the court rendered judgment.

To me what sets them apart is their ability to offer not just legal answers, but business-savvy counsel.
